The establishment of the National Advisory Council on Indian Education (NACIE) was one of the major provisions of the Indian Education Act of 1972, Pub. L. No. 92-318, 86 Stat. 235. NACIE consists of fifteen members who are appointed by the President and who must be American Indians or Alaska Natives.
Among its duties, NACIE is to advise the Secretary of Education with respect to the administration of and funding for all American Indian and Alaska Native education programs. NACIE must submit an annual report to Congress on its activities, including any recommendations for the improvement of Indian education programs and their funding. The Indian Education Act of 1972 is part of the Elementary and Secondary Education Act (ESEA) of 1965, Pub. L. No. 89-10, 79 Stat. 27. Successive reauthorizations of the ESEA have retained the provisions establishing NACIE; they are currently codified at 20 U.S.C. § 7471. In April 2004, President George W. Bush appointed the current members of NACIE, who were sworn in by U.S. Secretary of Education Roderick Paige on April 30, 2004.
However, beginning in fiscal year 1994 and continuing to this date, congressional appropriations for NACIE have been eliminated or so drastically reduced that preparation of the required annual report to Congress has been impossible.
NACIE recently published its FY2005-2006 report and its FY 2004-2005 report, available at this web site. Previous to this document, reports for fiscal years 1973 - 1993 were the only NACIE reports produced. Copies of NACIE reports can be obtained from the National Indian Law Library, or through other libraries, through ERIC (Education Resources Information Center) if ERIC has digitized them, or through reprint companies.
